Disclosure, Consent and Waiver of Liability Form

 

PLEASE READ CAREFULLY BEFORE SIGNING

 

Dear fellow Renegades--

 

No person may participate in any of our classes or partake in any of our services before reading and signing this form. The services provided by Renegade Yoga, LLC (yoga instruction, massage and similar services, which below we just call "Services") may involve strenuous aerobic and/or anaerobic exercise, bending, twisting, stretching, and/or close bodily contact with others, potentially very sweaty others! If your doctor has warned you against such things, if you have any health or physical or mental condition that would make your participation in our Services unadvisable, or if you find such things objectionable then definitely do not sign this form and do not participate.

 

Participation in our Services offers many potential benefits, but also involves obvious and non-obvious risks. You may experience unexpected and potentially unpleasant emotions that are difficult to explain. You may cry or become angry. You might injure yourself or be injured by others, possibly even unintentionally by our instructors or therapists. Some injuries could be serious (hey, it could happen).

 

We are a "hands on" facility:  A single touch is worth a thousand words.  Although our instructors or therapists will never intentionally touch your breasts or genitals, they will need to touch various other body parts while making postural adjustments or while providing massage services,  These touches might be soft, smooth, gentle, firm, determined, quick, or any combination thereof. By signing below and participating in our Services, you (for yourself and on behalf of your heirs, legal representatives and participating minor children), do hereby forever and ever:

 

1. Acknowledge that you have carefully read and understood the information above, that you have had appropriate opportunities to ask clarifying questions, that you are waiving and giving up any right to sue Renegade Yoga, LLC and certain other parties as further noted below, that you are signing this agreement voluntarily, and that you intend it to be a complete and unconditional release to the fullest extent permitted by law.

 

2. Assume all the risks of mental or physical injury, illness or death, or of experiencing enlightenment or cosmic consciousness (or not), as a result of participating in our Services.

 

3. Release, discharge and hold harmless Renegade Yoga, LLC and its owners, officers, employees, agents, instructors, teachers and representatives, whether in their capacities as such or individually, as well as your fellow students and any owners or leasees of any property from which Services are provided (all the foregoing collectively called "Released Persons") from any and all liability or responsibility, whether direct or indirect, resulting from your or your minor children's mental or physical injury, illness or death, or the experience of total enlightenment or cosmic consciousness, as a consequence of your or their participation in any of our Services.

 

4. Release, discharge and hold harmless all Released Persons from any and all liability or responsibility for loss, damage or theft of any property that you may bring onto any premises from which Services are provided ("Premises").

 

5. Agree to indemnify any and all Released Persons for any liabilities, costs, fees (including legal or medical fees) or expenses that they may incur as a result of you or your minor children mentally or physically injuring another person via your participation in our Services.

 

6. Authorize our instructors or therapists or their delegates to touch you or your minor children in the manner contemplated above while participating in any of our Services, as guided by their training, judgment and/or experience.

 

7. Agree to notify our instructors and therapists immediately if any touch, Service or adjustment proves painful or causes more mental or physical discomfort than you desire, and to instruct any of your minor children to do the same, and to do so as often as necessary to remind our instructors or therapists of your or your children's limits.

 

8. Agree that all Released Persons who are not parties to this agreement are nonetheless intended third party beneficiaries of this agreement and may independently seek its enforcement to the maximum extent provided by law.

 

9. Grant to Renegade Yoga, LLC ("Photographer") and its legal representatives, delegates and/or assigns, the irrevocable and unrestricted right to use and publish photographs or videos that Photographer or its delegates may take of you while in class or workshops or on Premises, or in which you may be included, for editorial, trade, advertising, and any other purpose and in any manner and medium; and to alter and composite the same without restriction and without your inspection or approval; and you hereby release Photographer and his/her legal representatives and assigns from all claims and liability relating to said photographs or videos.
